These terms govern your use of the chaimagal.com website. In-app terms for each app are linked from that app's page and apply when you install and use the app.
Acceptance
By accessing the website you agree to these terms. If you do not agree, do not use the website.
Use of the website
Use the website lawfully. Do not:
- Attempt to gain unauthorized access to any part of the website or our systems.
- Interfere with operation, including via malware, denial-of-service, or excessive automated access.
- Reverse engineer, scrape at impairing volumes, or use automated systems to extract content beyond reasonable use.
- Misrepresent yourself or impersonate another person or entity.
- Use the website in any way that violates applicable law.
Intellectual property
The website, its design, text, code, graphics, trademarks, prompt templates, model fine-tunes, and content are owned by chaimagal or its licensors except where noted. We grant you a limited, non-exclusive, non-transferable, revocable license to view the website for personal, non-commercial purposes. No other rights are granted.
User submissions and feedback
If you send us feedback, ideas, suggestions, or other submissions, you grant chaimagal a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, distribute, and create derivative works from those submissions for any purpose, including product development, marketing, and AI/ML training. You waive any moral rights in those submissions to the extent permitted by applicable law. Do not send us submissions that contain confidential information or third-party intellectual property you do not have the right to share.
Disclaimers and warranties
The website is provided "as is" and "as available." To the fullest extent permitted by applicable law, we disclaim all warranties — express, implied, statutory, or otherwise — including merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that the website is error-free, uninterrupted, secure, or free of harmful components.
Limitation of liability
To the fullest extent permitted by applicable law, chaimagal and its affiliates are not liable for any indirect, consequential, incidental, special, or punitive damages, or for lost profits, revenue, data, or goodwill. Our aggregate liability for direct damages arising from your use of the website is limited to the greater of (a) US$50, or (b) the amount you paid us in the twelve months preceding the claim. These limits do not apply to liability that cannot be excluded under applicable law (e.g. liability for death or personal injury caused by negligence, or for fraud).
Indemnity
You agree to indemnify and hold harmless chaimagal, its affiliates, and their respective officers, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the website, or your violation of any law or third-party right. This indemnity does not apply to the extent prohibited by applicable law.
Changes to these terms
We may update these terms from time to time. For material changes we will provide notice (banner, email, or in-app message) before the change takes effect. Continued use after the effective date of a change constitutes acceptance of the revised terms.
Termination
We may suspend or terminate your access to the website at any time, with or without notice, including for breach of these terms. Sections that by their nature should survive termination — intellectual property, disclaimers, liability, indemnity, governing law — survive.
Governing law and venue
These terms are governed by Israeli law. The competent courts in Modiin, Israel, have exclusive jurisdiction over any dispute, except where consumer-protection law in your jurisdiction provides otherwise.
Statutory consumer rights
Nothing in these terms limits your statutory rights as a consumer under the law of the country where you reside. EU consumers retain their rights under EU Directive 93/13 (unfair contractual terms) and the Consumer Rights Directive; UK consumers retain rights under the Consumer Rights Act 2015; Australian consumers retain rights under the Australian Consumer Law; Israeli consumers retain rights under the Standard Contracts Law (חוק החוזים האחידים) and consumer-protection law. Where any clause of these terms conflicts with non-excludable statutory rights, that clause is read down to the minimum extent of the conflict and the rest of the terms remains in effect.
