These are the Terms of Use for Mr. Anxiety. The Privacy Policy and EULA apply as well. The Privacy Policy describes the categories of data we may collect and the categories of recipients we may share with.
Acceptance
By installing or using Mr. Anxiety, you agree to these Terms of Use. If you don't agree, don't install or use the app. This is a binding agreement between you and Chai Magal (chaimagal).
The service
Mr. Anxiety is the Mr. Anxiety app (breathing and reflection). We distribute via the Apple App Store and Google Play. We may add, change, improve, or discontinue features at any time — including features that use cloud services, charge a fee, display advertising, or send your data to new third-party providers. Material changes are notified in-app and reflected in the Privacy Policy.
Your account
You are responsible for keeping credentials confidential and for all activity under your account. Tell us promptly of unauthorized access. One person per account. You must be at least 13. Where the age of digital consent in your jurisdiction is higher (e.g. 16 in Germany, Ireland, the Netherlands, Poland, and several other EU member states), users below that age need parental consent.
Acceptable use
You agree not to:
- Use Mr. Anxiety to break the law, infringe someone's rights, or harass others.
- Upload unlawful, hateful, or malware-laden content.
- Reverse-engineer beyond what local law permits, circumvent rate limits, or probe our systems.
- Impersonate anyone or use another person's account without permission.
- Abuse, overload, or use automated systems against any cloud service the app depends on, including AI inference endpoints, beyond the quotas and rate limits we set.
Your content
You keep ownership of what you put into Mr. Anxiety. You grant Chai Magal a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, back up, process, transmit, display, reproduce, modify, create derivative works from, aggregate, and otherwise use your content as needed to operate, improve, secure, market, and develop the app and our other products and services. This license includes use of your content to train, fine-tune, evaluate, and improve our and third-party AI/ML models, including via human review of representative samples by our personnel or contractors under confidentiality. We may use de-identified or aggregated derivatives of your content for any purpose, including commercial use. Where you submit content that you do not own, you represent that you have the rights necessary to grant this license.
AI features
Mr. Anxiety may include features that generate text, suggestions, or summaries using a language model. Some AI features run entirely on your device; others send your prompt and relevant context over TLS to a third-party AI provider for inference (a cloud AI feature). The Privacy Policy describes the categories of AI providers we may engage; specific providers we use may change over time.
AI output may be inaccurate, biased, outdated, or unsuitable for your situation. Do not rely on it for medical, legal, financial, clinical, mental-health, safety, or other professional advice. Reflect output is generated by a small model and may be inaccurate. If your reflection mentions self-harm, a static safe-messaging card is shown instead of AI output.
Subscriptions and fees
Mr. Anxiety is free to install. Some features may require a one-time purchase or a recurring subscription; paid features are clearly marked, and price, billing period, and renewal terms are shown before you buy.
Subscriptions auto-renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. You manage and cancel subscriptions in your Apple ID or Google account, not in the app. Introductory offers and free trials convert to paid subscriptions under the same renewal rules. Unused time on a multi-month plan may be forfeited when you cancel, in line with the app store's policy. Taxes may be added where applicable.
Purchases are processed by Apple or Google under their terms and refund policies; we do not see or store your card details. Where applicable consumer-protection law grants you a withdrawal or cancellation right (the EU 14-day right of withdrawal, the UK Consumer Contracts Regulations 2013, the Israeli Consumer Protection Law 5741-1981, California's Automatic Renewal Law, and similar laws), you may exercise it through the store or by emailing us. Australian consumers have non-excludable guarantees under the Australian Consumer Law; nothing in these Terms limits those.
Advertising
Mr. Anxiety may, now or in the future, display advertising — banner, interstitial, native, rewarded, or other formats. Where ads are enabled, we may work with third-party ad networks, ad-measurement, attribution, and retargeting providers, including for cross-context behavioral advertising as defined under California privacy law.
Users in the EU, EEA, UK, and Brazil will see an in-app consent prompt before non-essential ad tracking, in line with the ePrivacy Directive (and equivalent national rules) and GDPR. Users in California, Virginia, Colorado, Connecticut, Texas, and other US states with similar opt-out rights will have a "Do Not Sell or Share My Personal Information" control available in Settings, and we honor Global Privacy Control (GPC) signals. We do not permit ad partners to target ads to you based on sensitive categories (health, mental-health, pregnancy, religion, political views, sexual orientation, precise geolocation) derivable from the app.
Third-party services
Mr. Anxiety relies on third-party services to run. Categories of third parties we may engage are listed in the Privacy Policy and include: hosting and authentication, app distribution and in-app purchase processing (Apple, Google), crash reporting, analytics, cloud AI providers, advertising and marketing partners, attribution and ad-measurement, customer-support tooling, payment and tax compliance, and professional advisors. The specific providers we use change over time. When we introduce a new third party for a materially new use we will update the Privacy Policy and notify you in-app.
Termination
You may delete your account in Settings at any time; this terminates this agreement and triggers data deletion as described in the Privacy Policy (subject to legitimate retention periods). We may suspend or terminate accounts that violate these terms, with notice where reasonable. Sections on your content license, disclaimers, liability, indemnity, and governing law survive termination to the extent necessary.
Disclaimers
Mr. Anxiety is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant uninterrupted availability, error-free operation, security, or that the app meets your specific needs. AI output, summaries, suggestions, and third-party content are provided for your convenience and without warranty of accuracy or fitness. Mr. Anxiety is not a medical device; it is a wellness tool. If you are in crisis, contact local emergency services.
Limitation of liability
To the fullest extent permitted by law, Chai Magal and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill. Our aggregate liability is capped at the amount you paid us in the twelve months before the claim, or US$50, whichever is greater. Nothing excludes liability that cannot be excluded under applicable law — including non-disclaimable consumer-protection warranties in the EU, UK, Australia, Quebec, and Israel, and liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
What we will not do
We will not:
- Sell raw, identifiable personal data to data brokers (we may sell de-identified or aggregated data).
- Share personal data with insurers, employers, or law enforcement absent valid legal process or your consent.
- Use personal data for political-advertising targeting.
Changes
We may update these terms. We will update the date at the top. For material changes — including any change that expands the categories of data we collect, the categories of third parties we share it with, the purposes we use it for, or the price of a paid feature — we will notify you in-app (banner or launch screen) and, where we hold a verified email, by email, before the change takes effect. Continued use after the effective date constitutes acceptance; if you don't accept, you can delete your account before then.
Governing law
These terms are governed by Israeli law. Disputes are subject to the exclusive jurisdiction of the competent courts in Modiin, Israel — except where mandatory consumer-protection law in your country of residence provides otherwise.
Statutory consumer rights
Nothing in these terms limits your statutory rights as a consumer under the law of the country where you reside. EU consumers retain their rights under EU Directive 93/13 (unfair contractual terms) and the Consumer Rights Directive; UK consumers retain rights under the Consumer Rights Act 2015; Australian consumers retain rights under the Australian Consumer Law; Israeli consumers retain rights under the Standard Contracts Law (חוק החוזים האחידים) and consumer-protection law. Where any clause of these terms conflicts with non-excludable statutory rights, that clause is read down to the minimum extent of the conflict.
